Terms of contract

Note: This is the translation of the German terms of contract for publications and research data on the institutional repository of TU Braunschweig (LeoPARD). In case of any doubt, the German Version of these term is liable.

Publications

If you wish to submit your publications on the institutional repository of Technische Universität Braunschweig (TU Braunschweig), you will acknowledge the following terms of contract with your signature on the application:

  1. I hereby grant Braunschweig University Library the non-exclusive, perpetual right of use to copy and save the publication named above, make it publicly available and transform it into other data network systems on single demand. Any other rights of use thereby remain unaffected. Braunschweig University Librarydoes not pursue any economic interests with this publication. I do not get any compensation.
  2. I affirm to own the copyright of this work and I furthermore affirm – also in the name of potential co-authors –, that no rights of third parties are violated. This also includes any figures or other multi-media elements (e.g. pictures, graphic elements) potentially contained in the present work.
  3. The responsibility to avoid conflicts of interest does not lie with the University Library but only with the owner of the exploitation rights.
  4. I take full responsibility for all uploaded content and affirm that all documents disseminated by myself are of scientific character and especially do not glorify violence or hold any rabble-rousing or pornographic content, do not invite to commit crimes or violate a third party’s personal rights.
  5. Braunschweig University Library reserves its right to block public access to a publication in case of concrete evidence to a violation of rights. If there is no verifiable premediated or grossly negligent default on its behalf, the University Library is not liable for any damage due to a violation of copyright or exploitation rights. I affirm to inform the University Library immediately in case of doubt or the development of any putative or factual violation of rights.
  6. Metadata of all documents and their links to the full text are recorded in the catalogue of Braunschweig University Library as well as in catalogues of other institutions that are subject to public law. Within the scope of the mandatory disposal of web-based publications, metadata and electronic documents are transferred to the German National Library (Deutsche Nationalbibliothek).
  7. Braunschweig University Library has the right to convert the documents into other file formats or technically modify them alternatively, especially for the purpose of long-term archiving.
  8. Braunschweig University Library assumes no liability in case of illegal download, transformation or distribution of the publication elsewhere by a third person.

Research Data

If you wish to archive or publish your research data on the institutional repository of TU Braunschweig for at least 10 years in accordance with good scientific practice you will acknowledge the following terms of contract with your signature on the application:

  1. I hereby grant Braunschweig University Library the non-exclusive, perpetual right of use to copy and save the research data named above on its server, make it publicly available and transfer it into other data network systems on single demand. Any other rights of use thereby remain unaffected. By archiving and publishing the research data, Braunschweig University Library does not pursue any economic interests. I do not get any compensation.
  2. In case of publication of the research data, I affirm, also in the name of other persons involved in the creation of the data, that no rights of third parties are violated by such publication.
  3. The responsibility to avoid conflicts of interest does not lie with Braunschweig University Library but only with the owner of the exploitation rights.
  4. I take full responsibility for all uploaded research data and affirm that the content spread follows the present scientific standards. Especially as far as personal data are concerned, I have made sure that the applicable data protection regulations are not being violated, procedures of anonymization and pseudonymization have been undertaken, as well as declarations of consent have been obtained by the persons involved.
  5. Braunschweig University Library reserves its right to block public access to published research data in case of concrete evidence to a violation of rights. If there is no verifiable premediated or grossly negligent default on its behalf, the University Library is not liable for any damage due to a violation of copy or exploitation rights. I affirm, to inform the University Library immediately in case of doubt or development of any putative or factual violation of rights.
  6. Metadata of the published research data as well as an additionally submitted README-file with more detailed description of the data record will be made publicly available. Metadata will also be transferred to systems such as BASE and DataCite for the purpose of findability.
  7. Braunschweig University Library has the right to convert the documents into other file formats or technically modify them alternatively, especially for the purpose of long-term archiving.
  8. Braunschweig University Library assumes no liability in case of illegal download, transformation or distribution of the publication elsewhere by a third person.
